Provision of Legal Materials, Advice, and Opinions related to the ESG Legal Framework

Description

Under this engagement, ESA was responsible for developing Guidelines for Implementing ESG Principles from a Legal Perspective (ESG Legal Framework) for the various business lines of PT Pamapersada Nusantara (PAMA). ESA conducted a general assessment of PAMA’s business activities, identified ESG principles and practices applicable at both the national and international levels, analysed associated risks, and reviewed relevant ESG regulations to evaluate potential changes and compliance opportunities.

Furthermore, ESA prepared the ESG Legal Framework document and facilitated FGDs with ESG experts to ensure that the resulting guidelines are comprehensive, coherent, and applicable across all PAMA business lines.


The scope of work included providing legal materials and opinions on ESG regulations in Indonesia and advising on the application of ESG within PAMA’s business processes. ESA assigns an expert to serve as an expert who delivers analysis, explanations, and legal guidance on ESG implementation, including additional advisory support.

The outcome of this work is expected to strengthen PAMA’s understanding of ESG obligations, opportunities, and legal implications within its business operations.


Through this engagement, ESA provided materials, advice, and legal opinions related to the implementation of the ESG Legal Framework within PAMA. To support the execution of these tasks, ESA assigned an expert with relevant competencies. ESA supported the entire preparation process up to the early stages of implementation, including attending discussions, providing input or revisions to the ESG Legal Framework checklist document, and undertaking any other necessary actions to achieve the project objectives.

Title

Development of Guidelines for Effective Reporting and Monitoring of Forest Crime Cases in Indonesia

Description

This project aimed to develop Guidelines for Effective Reporting and Monitoring of Forest Crimes within the Bukit Harapan landscape. Through this collaboration, ESA Consultants carried out preliminary research on forest crime issues, identified relevant regulations, collected information through FGDs and interviews reviewing company procedures to obtain an initial understanding of the situation, actors, and impacts of forest crimes, prepared the draft reporting and monitoring guidelines, and conducted the field piloting of these guidelines.

The final output of the project was a guideline document that can be used by stakeholders to enhance the effectiveness of preventing and addressing forest crimes, especially in Bukit Harapan.

Review of Indonesia's Adherence to OECD Legal Instruments Required for Accession to the OECD

Description

ESA, together with a consortium led by PwC Legal Indonesia, provided comprehensive legal advisory services to the Coordinating Ministry for Economic Affairs (CMEA) regarding Indonesia’s current level of compliance with each relevant Organisation for Economic Co-operation and Development (OECD) legal instrument. The team also identified regulations, policies, and practices related to Indonesia’s compliance, as well as the steps required for Indonesia to align its laws, policies, and/or practices with OECD legal instruments and meet the core OECD principles outlined in the Roadmap.

Review of Indonesia's Adherence to OECD Legal Instruments Required for Accession to the OECD

Description

ESA appointed Archipel to conduct a review of Indonesia’s compliance with OECD legal instruments as part of the service provision for the Review of Indonesia’s Adherence to OECD Legal Instruments Required for Accession to the OECD. Archipel was responsible for working on 32 OECD legal instruments, including preparing the Supplemental Form (SF), Overview Matrix (OM), and Initial Memorandum (IM) in accordance with the milestones and guidance provided by ESA and PwC. Archipel also delivered monthly reports in the form of SF and OM, and provided a gap analysis for each instrument as required under OECD documentation.
